Plaintiff Victoria Hernandez (“Plaintiff”) has filed a lawsuit against Acceptance Insurance Agency of Tennessee Inc. (“Defendant”), in Los Angeles Superior Court, Case No. 20STCV03873, in which she alleges that Defendant failed to provide her and other non-exempt employees with meal and rest periods as required by California law, failed to pay meal and rest premium wages owed, failed to pay minimum wage, failed to pay overtime wages, failed to reimburse business expenses, failed to provide and maintain accurate wage statements, and failed to pay all wages due during and at the separation of employment. Plaintiff believes this lawsuit should proceed as a class action on behalf of herself and all other non-exempt employees of Defendant within the State of California, at any time after January 30, 2016.
Defendant denies all the allegations and contends it complied with California wage and hour laws at all times. Defendant asserts that Plaintiff’s claims are without merit. Further, Defendant denies that Plaintiff’s claims can properly be brought as a class action.
You are receiving this notice because Plaintiff’s attorneys are investigating the claims alleged above to determine whether this case may proceed as a class action. The Court has not yet made a decision as to whether the case may proceed as a class action.
